“Mailfeed Inc.” refers to the Mailfeed Corporation and excludes its shareholders, owners, or operators. "Zero” refers to product, or service owned and/or operated by the Mailfeed Corporation."Content" refers to any file or text that is emailed, shared, uploaded, or distributed through the Zero. "You", "Your" refers to the individual who uploads, emails, distributes content using Zero.

Zero is an application for email developed by Mailfeed Inc for use on mobile devices, such as smartphones, tablets, PDAs etc. The Zero application can be downloaded from Apple’s App Store or Mailfeed Inc. may grant you personal access to its distribution list. Zero app only works with existing email accounts, such as Exchange Hotmail, Gmail, Yahoo etc. To use Zero you must login to your email account after installing the application on your device.

Use of Zero is subject to the terms and conditions outlined in this document. As we continue to develop and improve the features of Zero and create additional services and make these services available to you as part of Zero, we will, from time to time, modify or update these terms and incorporate additional terms. These modified, updated or additional terms become part of your agreement with us if you continue to use Zero.

In order to use Zero, you must download and install Zero on your mobile device.

Mailfeed Inc. hereby grants to you, subject to this agreement, a non-exclusive, non-transferable license to use Zero. This License is for the sole purpose of enabling you to use Zero as provided by Mailfeed Inc., in the manner permitted by this agreement. You may not copy, modify, distribute, sell, or lease any part of Zero, nor may you reverse engineer or attempt to extract the source code of that software.

While using Zero, you are solely responsible for all activities occurring under your email account(s). You shall comply with all applicable local, state, and foreign laws, treaties and regulations in connection with your use of Zero, including without limitation, laws and regulations governing data privacy, international communications and transmission of technical or personal data.

You agree that the use of the Zero is entirely at your own risk. The Zero is provided on an "as is" basis without warranties of any kind, either expressed or implied, constructive, or statutory, including, without limitation, any implied warranties of merchantability, non-infringement or fitness for a particular purpose.

Mailfeed makes no guarantee of availability of service and reserves the right to change, withdraw, suspend, or discontinue any functionality or feature of Zero. In no event shall Mailfeed be liable for any damages, including, without limitation, direct, indirect, incidental, special, consequential, or punitive damages arising out of the use of or inability to use the Zero or any content thereon. This disclaimer applies, without limitation, to any damages or injury, whether for breach of contract, tort, or otherwise, caused by any failure of performance; error; omission; interruption; deletion; defect; delay in operation or transmission; computer virus; file corruption; communication-line failure; network or system outage; or theft, destruction, unauthorized access to, alteration of, or use of any record.

The content that you distribute through the Zero app is owned by you, and you give Zero permission to store, copy, modify, display and distribute said content. You are solely responsible for all materials transmitted or otherwise made available on Zero (“Your Content”). You retain ownership of any intellectual property rights that you hold on the content distributed, received, emailed or uploaded using Zero.

Mailfeed Inc. and/or its licensors owns all rights, title and interests, including all intellectual property rights, in and to Zero, the software, materials and other related content (excluding Your Content), and any derivatives, suggestions, ideas, enhancement requests, feedback, recommendations or other information provided by you or any other party relating to Zero. In addition, all content published on Zero, including, but not limited to, reports, presentations, written content, graphics, images, marks, logos, sound or video clips, and Flash or Java animation, are protected by Mailfeed Inc.’s copyrights or trade-marks.

You agree to indemnify and hold Mailfeed Inc. harmless from any loss, liability, claims, damages and expenses, including attorneys fees, arising from or related to the use of Zero or use of any other feature or service provided by Mailfeed Inc. This expressly includes:

* Your responsibility for any and all liability arising from the violation or infringement of proprietary rights or copyrights. * Any defamatory or unlawful actions or content distributed, uploaded or emailed while using Zero.

The Web Site and Zero feature trade-marks, service marks, and logos that are the property of Mailfeed Inc. and/or its affiliates, suppliers, partners and licensors.

The Web Site and Zero may also include trade-marks, service marks or logos of other third parties. All of these trade-marks, service marks and logos, including but not limited to GMAIL, GOOGLE, YAHOO!, IPHONE, APPLE, HOTMAIL, OUTLOOK and ICLOUD are the property of their respective owners, and you agree not to use them in any manner without the prior written permission of the applicable owner.

You are responsible for maintaining the confidentiality of your email account(s) credentials and for taking reasonable measures to prevent others from gaining access to your account(s).

No part of the Zero or Web Site may be reproduced or recreated without explicit written permission.
